The agency also recognizes the importance of ensuring broad and equitable access to all the tools and resources that can help currently addicted smokers seeking to quit, including those who smoke menthol cigarettes and would be impacted by these public health measures. The FDA will work with partners in other federal agencies to make sure the support is there for those who are trying to quit. The FDA also remains focused on its regulatory oversight of e-cigarettes and other electronic nicotine delivery systems (ENDS). The Center for Tobacco Products recently provided an update on its ongoing work of conducting the premarket review of ENDS and other tobacco product applications, and has issued warning letters to ENDS product manufacturers and retailers who continue to sell products that are illegally on the market. The FDA has also made a significant investment in a multimedia e-cigarette public education campaign. The campaign targets nearly 10.7 million youth aged 12-17 who have ever used e-cigarettes or are open to trying them, and highlights information about the potential risks of e-cigarette use.

After a smoker switches completely to e-cigarettes, they should also stop using e-cigarettes to achieve the maximum health benefit. Many youth and young adult e-cigarette users, many of whom never previously used tobacco, are also in need of support to quit (see sidebar This is Quitting). Evidence from multiple sources indicate that both youth and young adult e-cigarette users want to quit and have made a quit attempt. Nearly two-thirds of adult e-cigarette users plan to quit vaping and almost a quarter of adolescents attempted to quit vaping in the past year. Here is what we know about reasons for quitting vaping:


E-cigarettes contain nicotine, sometimes at levels near or exceeding those found in combustible cigarettes. Nicotine is harmful to developing brains: younger users are more likely to become addicted, have more difficulty quitting and may be at higher risk for addiction to other substances in the future. While new products may be beneficial to smokers who completely switch from combustible tobacco, they still pose health risks and nonsmokers should never use them.


The CDC has recommended that those who use e-cigarettes consider quitting and that children and women who are pregnant should not use e-cigarettes. For those who use e-cigarettes and experience similar symptoms CDC recommends seeking prompt medical care. It is important to note that the CDC has not conclusively determined the cause of the EVALI illnesses and researchers are not sure what combination of short-term, long-term or repeated exposure may contribute to lung injury.


Twenty-seven states and the District of Columbia have decriminalized small amounts of marijuana. This generally means certain small, personal-consumption amounts are a civil or local infraction, not a state crime (or are a lowest misdemeanor with no possibility of jail time). In 2014 and preceding the successful legalization ballot measure, the District of Columbia enacted legislation, which passed congressional review, and made possession or transfer without remuneration of one ounce or less of marijuana a civil violation.


The law prohibits the sale of tobacco products via vending machines and within 100 yards of any educational institution. In addition, several states ban the sale of single cigarettes and gutka and other forms of smokeless tobacco. There are no restrictions on internet sales or the sale of small packets of cigarettes or other tobacco products. The sale of tobacco products is prohibited to persons under the age of 18.


The Prohibition of Electronic Cigarettes (Production, Manufacture, Import, Export, Transport, Sale, Distribution, Storage and Advertisement) Act, 2019 (No. 42 of 2019) replaces the 2019 E-Cigarette Ordinance and bans the sale and advertising of e-cigarettes, e-cigarette components and HTPs.


Today, the U.S. Department of Justice announced an update to its federal marijuana enforcement policy in light of recent state ballot initiatives that legalize, under state law, the possession of small amounts of marijuana and provide for the regulation of marijuana production, processing, and sale.


If you are a marketplace provider with no physical presence in New York State, you must register for sales tax if, in the previous four sales tax quarters, your cumulative total of gross receipts from sales made or facilitated of tangible personal property delivered into the state exceeded $500,000, and you made or facilitated more than 100 sales of tangible personal property delivered in the state.


However, a manufacturer must register for sales tax for other reasons. Manufacturers must be registered for sales tax to accept resale certificates from their customers, and to buy certain items (such as raw materials, machinery, equipment and electricity used in production) without paying sales tax. You are required to register for sales tax if you make items at your home and bring them to other locations to sell, or if you sell them over the Internet, if the items that you are selling are subject to sales tax. Items commonly sold at craft fairs and through online auction sites, such as knitted and crocheted items, homemade soaps and candles, holiday decorations, woodworking projects, and homemade candy are just a few examples.


A casual sale is an occasional or isolated taxable sale by a person who is not in the business of selling taxable property or services. People who make casual sales from their home and have no intention of making sales on a regular basis as a business do not have to register for sales tax. These occasional sales must be made from your home, and the purchaser must pick up the item at your home.


The exemptions that apply to sales made from your home do not apply to sales that are made through an auctioneer, sheriff, or other third party, or to a sale held to liquidate an estate. These types of sales are considered sales by a vendor and are subject to sales tax. The tax is collected by the auctioneer, sheriff, or third party, and the private resident individual is not required to register.


Special rules apply to sales made by exempt organizations such as religious and charitable organizations, and public and private school groups. Publication 843, A Guide to Sales Tax in New York State for Exempt Organizations, provides information on the requirements for an exempt organization to be registered for sales tax.


Siegel: It is certainly a smart move for the FDA to crack down on illegal sales of electronic cigarettes, including Juul and other vaping products, to youth. The agency should take enforcement action against retailers that are selling these products to underage youth and against companies that are marketing their products to youth.


What the FDA may be jeopardizing if it follows through with its threat to ban flavored e-cigarettes is the health of adults in this country. Many adult ex-smokers are able to stay off traditional cigarettes only because of the availability of flavored e-cigarette alternatives. A ban on flavored e-cigarettes is tantamount to a ban on the sale of vaping products, because there are virtually no unflavored e-cigarette liquids on the market.


The first is to increase the price of the product. State and local governments could impose taxes on these products to deter youth use. If they do this, they should increase the tax on cigarettes to an even higher level to make sure that price remains a deterrent to smoking and an additional incentive for smokers who cannot quit completely to switch to vaping.

The exposure of children and young people to appealing marketing is of particular concern, as is the targeting\r\nof new markets in developing and low- and middle-income countries with a current low prevalence of alcohol consumption or high abstinence rates. Both the content of alcohol marketing and the amount of exposure of young people to that marketing\r\nare crucial issues. A precautionary approach to protecting young people against these marketing techniques should be considered.

Thus control measures could be different for illicit alcohol and informally produced alcohol and should be combined with awareness raising\r\nand community mobilization. Efforts to stimulate alternative sources of income are also important.
